1. Acceptance of these Terms

These Terms of Service (“Terms”) govern your access to and use of puntacanaintel.com (the “Platform”), operated by True Technologies LLC (“we”, “us”). By creating an account or purchasing a membership, you agree to these Terms. If you do not agree, do not use the Platform.

2. What the Platform Is — and What It Is Not

The Platform provides market data, analytics, calculators, and educational content about real estate investment in the Punta Cana region of the Dominican Republic.

The Platform does not provide investment, legal, tax, or financial advice. All content — including zone metrics, cap rates, ROI scenarios, risk scores, and CONFOTUR information — is for informational and educational purposes only. Nothing on the Platform constitutes a recommendation to buy, sell, or hold any property or asset. Always conduct your own due diligence and consult qualified legal, tax, and real estate professionals licensed in the Dominican Republic before making any investment decision.

3. Data Accuracy and Sources

Zone metrics (prices per m², cap rates, occupancy, ADR, appreciation, and derived figures) are market estimates compiled from official and secondary sources, each labeled with a “data as of” date. Figures are updated periodically but may not reflect current market conditions. We do not warrant the accuracy, completeness, or timeliness of any data.

CONFOTUR notice: CONFOTUR (Law 158-01) classification applies to specific projects (and even project stages) by resolution — never to zones. A pending application is not an approved resolution. Tax benefits apply only to units within a classified, currently valid project and are not retroactive. Any CONFOTUR information on the Platform must be independently verified with MITUR and your attorney before relying on it.

4. Accounts

You must provide accurate information when registering and keep your credentials secure. You are responsible for all activity under your account. One account per person; accounts and memberships are not transferable or shareable.

5. Memberships, Billing and Renewal

• Free: $0 — basic market exploration features. No card required.
• Premium Monthly: US$29 per month, billed monthly until cancelled.
• Premium Annual (Founding): US$149 for the first year (limited founding offer), renewing at US$199 per year thereafter unless cancelled.

All prices are in US dollars. Payments are processed securely by Stripe; we do not store your card details. Subscriptions renew automatically at the end of each billing period until you cancel. Prices for new billing periods may change with at least 30 days’ notice; changes never affect a period you have already paid for.

6. Cancellation

You may cancel at any time from the Account page (Subscriptions tab). Cancellation stops future renewals; you keep Premium access until the end of the period you already paid for. No partial refunds are given for unused time, except as described in our Refund Policy.

7. Refunds

Refunds are governed by our Refund Policy, which is part of these Terms.

8. Acceptable Use and Intellectual Property

All Platform content — data sets, analytics, methodology, reports, text, and design — is our property or licensed to us and is protected by intellectual property laws. Your membership grants you a personal, non-exclusive, non-transferable license to use the Platform for your own investment research. You may not:

• scrape, bulk-download, or systematically extract Platform data;
• resell, republish, or redistribute Platform content or data, in whole or in part;
• share your account or circumvent access controls;
• use the Platform to build a competing product or train models on our data without written permission.

Brief quotations with attribution and a link to the Platform are welcome.

9. Third-Party Services

Payments are handled by Stripe under its own terms and privacy policy. The Platform may link to external sources (e.g., MITUR); we are not responsible for third-party content.

10. Disclaimer of Warranties and Limitation of Liability

The Platform is provided “as is” and “as available”, without warranties of any kind. Real estate investment involves substantial risk, including loss of capital. To the maximum extent permitted by law, we are not liable for any investment losses or for indirect, incidental, or consequential damages arising from your use of the Platform. Our total aggregate liability for any claim is limited to the membership fees you paid us in the twelve (12) months preceding the claim.

11. Termination

We may suspend or terminate accounts that violate these Terms (including data scraping or account sharing) without refund. You may delete your account at any time by contacting us.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced on the Platform or by email at least 15 days before taking effect. Continued use after the effective date constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the Commonwealth of Puerto Rico, United States, without regard to conflict-of-law rules. Any dispute will be resolved in the courts of Puerto Rico.
